PASSENGER TICKET CONTRACT
The terms and conditions below summarize certain terms and conditions applicable to travel on the m/s Paul Gauguin. For more information, please see the Passenger Ticket Contract, which includes more detailed information as well as important information regarding such things as limitations of liability.

AIRPORT CHECK-IN
It is recommended that all guests check in with the airline at least two (2) hours prior to departure for domestic flights and three (3) hours prior to departure for international flights.
AIR TRANSPORTATION
Air transportation charges are for economy/coach or similar class of service on scheduled or charter services of IATA, U.S. or international air carriers. Designated air departure or return cities are at the discretion of PGC and are subject to change without notice. PGC reserves the right to choose the air carrier, routing and scheduling to and from each city and the right to substitute charter flights for scheduled air and vice versa. Service is subject to availability. All airfares quoted are subject to change without notice. Airfare is not guaranteed until full payment for the cruise/air package has been received and documents/airline tickets have been issued. Airline tickets issued by PGC may be restricted as a result of the type of airfare arranged. As a result, you may find that your ticket may not be reissued or exchanged for another air carrier or routing. Cancellation or rebooking charges may be assessed by the airline for any changes made to the ticket. These charges are the sole responsibility of the guest. Advance seat selection is subject to the policy of the participating air carrier and may not be available. The service and responsibility of the air carrier used in conjunction with any PGC cruise program is subject to and limited by the “Contract of Carriage” as specified by the air carrier for each ticket issued. Reconfirmation of airline schedule is suggested 72 hours prior to travel.
AIRLINE BAGGAGE REQUIREMENTS
The allowance per passenger for checked or carry-on luggage on an aircraft depends on the policy of the applicable airline. Guests are solely responsible for any baggage fees and excess baggage fees charged by the airline. We highly recommend you contact the airline directly or visit their website for luggage regulations. Please note that domestic Air Tahiti flights have a strict baggage limit of 20 kg (44 lbs.) per person. Neither PGC nor any of its affiliates is responsible for baggage or other personal property that is damaged, misplaced or lost by the airline.
BOOKING TRANSFER REQUESTS
Bookings may be transferred from Paul Gauguin Cruises to a travel agency, or from one travel agency to another within 30 days of original booking date. Beginning 31 days after booking date, booking transfers are subject to all cancellation terms, pricing changes, and new terms and conditions.
All new bookings including Groups beginning October 7, 2024, are subject to the following payment and cancellation terms:

There is no grace period after 90 days. Bookings not paid in full at 90 days (or 30 days with prior policy) are subject to cancellation.

GROUP bookings made January 1 - September 18, 2022 for travel in 2023 forward, the following policy applies:

Sail With Confidence policy does not apply to groups traveling in 2023 forward. For all invoices, including group invoices, we direct guests to our website to view our terms and conditions and cancellation policy. Final payment for Group bookings is due 90 days prior to sailing.
For this purpose, “Departure Date” means the date the sea, air/sea or air/sea/land program first departs and “Full Fare” means the full cost of any cruise, hotel or air component purchased from PGC. Some components may have different refund and/or cancellation policies and penalties and, if so, these will be explained at time of booking. All cancellations need to be made in through our reservations department by calling 800-848-6172 or in writing by email to CustomerService@pgcruises.com.
DEPOSIT AND PAYMENT
A deposit of 25% of the fare is required within 72 hours of booking to confirm a reservation. Payments cannot be transferred to an alternative booking within 120 days of sailing. Unless otherwise noted, final payment must be received by PGC 90 days prior to date of travel. Final payment must be received within 48 hours of booking for bookings made 89 to 30 days prior to sailing. For reservations made 29 days or less prior to sailing; full and final payment will be due at the time of booking. PGC reserves the right to cancel any booking not fully paid at final payment due date. Payment may be made by bank wire, personal check, American Express, Visa or MasterCard. Once a deposit is made, all changes are subject to an administrative/cancellation fee.
CHANGES IN ITINERARIES
Guests acknowledge that the scheduled itinerary is subject to delay, modification, or port-of-call cancellation due to weather and other causes beyond the control of the ship captain, the ship manager or PGC. If necessary or appropriate, as determined in the discretion of the captain, the ship manager or PGC, the ports of call and itineraries may be changed. Further, reservations are subject to change in the event of a full ship charter. In the event of a charter of the vessel or stoppage of labor for whatever cause or for any other reason beyond the control of the ship manager or PGC, either the captain, the ship manager or PGC may cancel or postpone any scheduled sailing and will not be liable for any loss to guests by reason of such cancellation or postponement.
CHILDREN
Any child under the age of 18 must be accompanied by an adult over the age of 21. If the adult accompanying the child is not a parent, a “Parental Consent Guardianship Form” must be signed by a parent or legal guardian and received by PGC prior to sailing. The ships are not able to accommodate children under one year of age and reserve the right to restrict the number of those under three years of age on board. Babysitting services are not available. Parents must be diligent to guard their children while on or near the balconies or any railing. The ships are not equipped to provide pre-natal, post-natal or pediatric services.
CRUISE FARES: SINGLES, TRIPLES AND CHILDREN
The cruise fares shown are in U.S. dollars and are per person, double occupancy, are for new bookings only, are subject to availability, may not be combinable with other offers, are capacity controlled and may be withdrawn at any time without prior notice. Port, security and handling fees of $140 to $400 are included. Third berth guests pay full air add-on. Pricing for the third guest in the same stateroom is as follows: 17 years old and under, sail FREE, 18 years of age and older, 30% of adult fare. PGC reserves the right to limit the number of single-occupancy cabins on any sailing. The single supplement for categories OS, GS, A, B, is 100% of listed cruise fare; 50%-100% for categories C and D; 0%-50% for staterooms 763, 764 and categories E and F. Single supplements are in addition to listed cruise fare and varies by voyage.
The fare paid by the guest covers all normal shipboard services, meals, gratuities, accommodations and facilities. It does not cover airfare (unless otherwise specified), shore excursions, sightseeing or meals ashore, port charges, NAFTA or airline taxes, air and cruise ship fuel surcharges, airline ticket fees, premium liquor and wine, laundry or valet services or any other items or services of a personal nature unless otherwise specified. Air taxes and air fuel surcharges are estimated by PGC at the time of sale based on taxes and fuel surcharges levied by air carriers traveling to your destination and fuel/oil prices in the world at that time. The actual amount charged may vary. The amount herein may vary. The cruise ship fuel surcharge is additional revenue to the ship operator. PGC makes every effort to adhere to the specifics shown in this or any publication. However, circumstances may necessitate variations. Pre-registered rooms for early check-in, flight schedules, hotels and transfer prices are based on exchange rates and available contracts at the time of printing.
PGC reserves the right to change these prices for exchange rate and other fluctuations at its discretion. All cruise and air fares listed are in effect at the time of printing. Cruise fare is guaranteed when the payment of deposit is received; the only exception is an event causing significant change in company operating costs, such as a major change in world conditions or a sharp increase in fuel, oil prices or other circumstances beyond the control of PGC. All information contained herein is subject to change.
Paul Gauguin Cruises reserves the right not to honor any published prices that it determines were erroneous due to printing, electronic, or clerical error.
CURRENCY
All payments made to PGC must be in U.S. dollars, the official currency aboard ship. At the time of embarkation, we request a confidential registration of an accepted credit card. The night prior to your final disembarkation from the ship, a detailed statement of your shipboard charges for onboard services and products will be delivered to your suite. All such charges must be paid in full by cash, or accepted credit card (Visa, MasterCard and American Express). Please note that travelers' checks are not accepted on board.
DRESS CODE
Country Club Casual, or elegant resort wear, is appropriate dress for all evenings aboard The Gauguin. Country Club Casual consists of a dress, or skirt or slacks with a blouse or sweater for ladies, and slacks and collared shirts for gentleman. No ties are required at any time, although gentlemen may opt to wear a jacket to the Captain’s Welcome Reception. Please note that casual wear such as shorts, t-shirts, casual jeans (frayed and/or with holes), baseball caps, flip-flops, and Crocs are not considered appropriate after 6:00 p.m. in all restaurants and lounges. Bathrobes and bathing suits are not appropriate in the ship’s restaurants and lounges, and shirts and shoes are required in all public areas at all times.
DRUG POLICY
Persons in possession of illegal drugs are subject to immediate disembarkation and reporting to law enforcement authorities. This could result in legal proceedings. Please keep in mind that the drug laws in many countries can be very restrictive and the penalties severe. For these purposes, marijuana, even if prescribed for medicinal purposes, is considered an illegal drug as it is prohibited both under U.S. law as well as the laws of all or most of the countries that the ship visits. Prescription Marinol, which is used by some as an alternative to marijuana, is permitted. Paul Gauguin Cruises holds a strict alcoholic beverage service policy. The minimum legal age for drinking alcoholic beverages on board is 18 years of age.
EMBARKATION/DISEMBARKATION
Please refer to your cruise ticket for confirmation of embarkation time. For disembarkation, guests should plan on vacating their stateroom early on the morning of disembarkation day.
FLIGHT CONFIRMATIONS
PGC will confirm preliminary flight schedules no later than 60 days prior to departure. Final schedules will be included with your cruise documentation. Because airlines occasionally change flight schedules, we recommend you reconfirm your flight numbers and times 72 hours before departure. For airline seat assignments, special meal requests and the addition of frequent flyer numbers to records, you must contact the airlines personally or through your travel advisor. At time of final payment (90 days prior to travel), all air records must be finalized with traveler’s name as it appears in passport, date of birth and gender.
PGC air program requires the issuance of airline tickets 75 days prior to the travel date. If we do not have the required guest information at the time of final payment (90 days prior to travel), guests could be liable for obtaining their own flight arrangements and subsequently be responsible for the cost of their air travel.
GRATUITIES
All shipboard gratuities for onboard room stewards, bar staff and dining staff are included in your cruise fare. Gratuities for concessions such as the spa and beauty shop are not included and may be optionally added at the guest’s discretion.
GUEST TRAVEL PROTECTION PROGRAM
We want to ensure your trip is nothing short of an exceptional experience. Whether you’ve paid a deposit or are preparing to make final payment, you can still protect yourself and your travel investments to enjoy greater peace of mind before and during your voyage. For our guests living in the United States or Canada we recommend a protection plan from our award-winning travel insurance partner, Allianz Global Assistance. Our guests living outside the U.S. and Canada may purchase coverage through Trawick International.
HEALTH AND MEDICAL MATTERS
Each guest represents and warrants that he or she is physically and otherwise fit to travel on the voyage. Please visit our Travel Advisory page for the most up to date health protocols. PGC will not accept reservations for guests who will be past the sixth month of pregnancy by the end of their cruise. Any physical, emotional or mental condition that may require professional attention during the cruise must be reported to PGC at the time of booking. Guests requiring the use of wheelchairs must notify PGC at the time of booking and should be aware that the marina area on the ship is not accessible via elevator and that most ports on the cruise require tenders to go ashore and may preclude a wheelchair guest from leaving the vessel. Decisions made by the ship’s captain in such circumstances will be binding. PGC strongly recommends that wheelchair guests travel with someone who is able to assist them. Wheelchairs provided on board are for emergency purposes only. Guests requiring a wheelchair are required to provide their own on board. Shipboard medical services and facilities, including doctor and medications, are available to guests at a reasonable charge.
MEDICAL FACILITIES
The Medical Center is designed to provide medical care for certain temporary illnesses and accidents. These facilities are not intended or capable of providing ongoing treatment of pre-existing medical conditions. Any such special requirement or need for health services aboard ship must be cleared in writing with PGC before booking(s) will be accepted. The ship’s doctor is on 24-hour call for professional and emergency services, which are available at customary charges. For guests requiring oxygen equipment, an oxygen concentrator is the only form of oxygen equipment allowed aboard ship and must be provided by the guest. Wheelchairs provided onboard are for emergency purposes only.
MUSTER POLICY
Current legal requirements for conducting a muster of passengers are found in the International Convention for the Safety of Life at Sea (SOLAS) and mandate that a muster for embarking passengers occur within 24 hours of their embarkation. Notwithstanding the legal requirement, Paul Gauguin Cruises has identified a best practice that calls for conducting the mandatory muster for embarking passengers prior to departure from port. This muster drill will take place at 5:30 pm on embarkation day. We ask that all guests who have arrived be on board for this drill. Guests arriving after the muster has been completed will be provided with individual or group safety briefings upon embarkation prior to a full muster drill the following morning. This practice exceeds existing legal requirements and has been adopted to ensure that any mandatory musters or briefings are conducted for the benefit of all newly embarked passengers at the earliest practical opportunity.
NAME CHANGES
Name substitutions are not allowed at any time. After final documentation has been issued, corrections to cruise tickets and/or hotel reservations may be made for a $100 per-person fee. Changes on airline tickets are subject to airline approval. In some instances, name corrections may result in the loss of original air reservations and a minimum $150 change fee per person. Alternate air carriers may then be substituted at PGC’s discretion. Non-refundable airline tickets issued will not allow name changes at any time.
NON-SMOKING POLICIES
While smokers are given a warm welcome, we recognize the need to restrict where smoking is permitted so as not to cause discomfort to, or provide a health or safety hazard for, the majority of our guests who do not smoke. Although smoking is prohibited in all suites, staterooms, indoor public areas and private balconies, there are multiple outdoor areas on each vessel where smoking is permitted.
OPTIONAL HOTEL STAYS AND LAND PROGRAMS
PGC offers guests the option to purchase hotel stays or land programs. You may extend your stay in your port of embarkation or disembarkation or opt for an exclusive package in some of the most prestigious hotels in the world. The prices include room, tax, service charges, breakfast, local hospitality service and transfers as applicable. Please note these rates do not include early check-in or late check-out, unless otherwise indicated. One night or additional nights’ accommodations may be purchased to ensure early check-in for guests arriving on early flights. Late check-out may be arranged and paid directly to the hotel on a space availability basis. PGC reserves the right to substitute hotels. Land programs are subject to cancellation if a minimum number of participants is not reached. In this case, guests will have the option of purchasing the program on a private basis for an additional cost. If the program is cancelled by PGC, guests who have booked their air through the PGC Air Program, and do not choose to accept the new offer, will have their flight changed to PGC air between their gateway city and the ship without incurring a change fee. For guests booking their own air in conjunction with a land program, refundable tickets are strongly recommended as PGC cannot be held responsible for any travel costs incurred if a land program, tour or private arrangement made through PGC is cancelled due to participation minimums not being met.
Baggage allowance varies on flights in conjunction with optional land programs and overland shore excursions. Guests should verify weight limits, as excess baggage charges are the responsibility of each guest.
The itinerary for land programs listed in the brochure and on the website is based on current flight itineraries and other service suppliers expected to be operating for this program at the time of publication. Changes to flight availability, itinerary and program are subject to change without previous notice. Change in programs’ itinerary or content, or cancellation by PGC of any of these programs does not constitute grounds for your cancellation of the voyage.
Guests participating in the PGC Air Program and not deviating will receive airport transfers to/from the pier or hotel. For guests with independent flight arrangements, a private car transfer from the airport to the pier can be purchased in advance, and PGC reservations must be advised of flight information at least 30 days prior to departure. It is the guest’s responsibility to keep PGC reservations updated with any changes in flight information. Failure to present correct information will result in loss of transfer and 100% penalty. Motorcoach transfers may only be booked pre-cruise for guests with independent flight arrangements in Papeete. All post-cruise transfers can only be booked on board at the Travel Desk. Published programs cannot be deviated. Guests wishing to deviate may set up a similar private program through the Travel Concierge Desk.
Weather conditions are unpredictable. While PGC and its appointed ground operators will do all they can to assist with alternative arrangements, we cannot be held responsible for any costs incurred if a land program, tour or private arrangement made through PGC is disrupted due to adverse weather conditions. The Guest Protection Program provides coverage for excessive delays, if due to inclement weather, strikes or equipment failure of a common air carrier. To obtain this coverage, the premium must be paid if full at the time your final payment is made. Rates are quoted in U.S. dollars on the current rate of exchange and tariff as of the time of publication. PGC reserves the right to increase hotel and tour program prices to cover increased costs, tariffs and taxes and to reflect fluctuations in foreign exchange markets. Published prices and inclusions are subject to change without notice.
PAYMENTS
All payments by guests to PGC or its service providers for services rendered during the cruise must be made in U.S. currency and must be paid before final disembarkation.
PETS
Pets and other animals are not allowed onboard the ship.
SHORE EXCURSIONS
Shore excursions are available for purchase on board the vessel or can be pre-reserved through our Reservations Department at (800) 848-6172. Information pertaining to pre-reserved tours will be sent with final documentation. Pre-reserved shore excursions will be billed to your shipboard account and are non-refundable after the closing deadline. To avoid cancellation penalties, the Travel Concierge Desk should be notified prior to the closing deadline, which is 12:00 noon the day before the tour departs, unless otherwise indicated. PGC reserves the right to withdraw any program if minimum participation requirements are not met. Tour prices and specific itineraries are subject to change without notice. Shore programs do operate in wet weather, but within safety guidelines. Should the weather conditions be outside these guidelines, the program will be cancelled by the tour operator, and a refund or credit will be processed at the end of the cruise. The program is non-refundable for voluntary refusal to participate in a program due to inclement weather when the program is still operational.
TICKET CONTRACT AND RESPONSIBILITY FOR TRANSPORTATION
The transportation of guests and baggage, to the m/s Paul Gauguin is provided solely by the owner and manager of the respective ship and is governed by the terms and conditions printed on the Passenger Ticket Contract (Ticket/Contract). The Ticket/Contract is an important document and should be read carefully. Your acceptance of a Cruise Voucher constitutes agreement to the terms and conditions of the Ticket/Contract.
PGC or the ship manager may choose not to accept any person as a member of the cruise for any reason. Any cruise may be cancelled, shortened or lengthened as circumstances so demand. The right is reserved to assess fares and charges in effect at the time of sailing. While great care has been taken to offer the finest services available, neither PGC nor the ship manager is responsible for any act, event or omission during the time that guests are not on board the ship. All arrangements for air transportation, lodging, transfers and shore excursions are made by PGC solely as an accommodation for the suppliers of the services featured in this brochure. Each guest agrees not to hold PGC, its owners, its advisors or representatives liable (in the absence of willful misconduct or gross negligence) for any loss, injury, expense or damage that results either directly or indirectly from any act or omission, whether negligent or otherwise, of any person or firm that provides any goods or services in connection with the trip or any available option. Without limiting the foregoing, neither PGC nor the owner or manager of the ship shall have any liability to any guest for the quality of services and the condition of cleanliness at a hotel or housing facility, or for any transportation delay, including, but not limited to, liability for inconvenience, shortened vacation time, additional expense, or any other kind of damage. PGC expressly disclaims all responsibility of any nature whatsoever for any loss, damage or injury to property or person from the provision of any air, rail or motorcoach transportation. Deposit or payment for a reservation constitutes consent to all terms and conditions set forth herein and in the Ticket/Contract.
TRANSFERS
Transfers are included if guests are booked on a PGC air or hotel program.
TRAVEL DOCUMENTS
Travel documents vary based on cruise itinerary. It is the sole responsibility of guests to identify and obtain all required travel documents for the entire cruise vacation and have them available when necessary. Valid travel documents such as passports and Visas are required for boarding and re-entry into the United States and other countries.
All guests must carry a valid passport. Passports must be valid for at least six months after your return date of travel. Guests are responsible to ensure validity dates of passport and to secure proper documentation for countries visited. Please consult your respective State Department or Foreign Ministry for specific Visa and entry requirements for countries scheduled on your itinerary. For U.S. citizens, further information can be found by visiting: https://travel.state.gov/. Consult your healthcare professional for any inoculations you may require, or contact the Centers for Disease Control & Prevention (CDC) toll-free at 1-800-CDC-INFO (1-800-232-4636) or online at www.cdc.gov/travel.
VISAS
It is the sole responsibility of guests to identify and obtain all required Visas for the entire cruise vacation and have them available when necessary. PGC accepts no responsibility for obtaining required Visas nor advising guests of Visa or other immigration requirements.
• Tahiti: Citizens of the U.S., Canada, and European Community are not currently required to have an entry Visa for Tahiti, but a passport that is valid for at least 6 months after the completion of travel, and a valid return airline ticket are necessary.
CRUISE DOCUMENTS
All guests will receive electronic documents automatically. It is essential that all necessary guest information is accurately provided, and there should be no remaining balance on your booking.
AIR AND LAND SUPPLEMENTAL PROGRAMS
Paul Gauguin Cruises is pleased to offer guests the opportunity to participate in programs that incorporate the air and land components of their travel with their cruise. Details of these programs are set forth below.
AIR/SEA PROGRAM FOR CRUISES ON THE m/s PAUL GAUGUIN
Our Air/Sea Program for cruises on the m/s Paul Gauguin incorporates air travel from Los Angeles as part of the package. Other designated gateway cities are available for a supplement. The air transportation is based on economy class or coach travel using carriers and routing determined by PGC. Air transportation is subject to availability and specific class of service. If dictated by flight schedules, day room accommodations will be included.
Schedules: Schedules in the Air/Sea program are based on the schedules of PGC’s airline partners at the time of brochure printing.
Air Concierge: We offer guests the opportunity to request changes to their flight itineraries and/or travel dates. This service is available on all deposited bookings for a $100 per-person fee, per change, plus any applicable service charges and/or supplier fees. Please note that fee does not apply when requesting a standard upgrade to First or Business Class. When deviating from our standard air/sea program, guests will forfeit any transfer, hospitality services, and hotel accommodations that may be included in the standard air/sea or land programs.
Upgrades: Air upgrades may be available for both the trans-Pacific portion of the flight and domestic legs to the international gateway city. Please contact reservations for details and pricing.
Availability and Changes to Program: The Air/Sea Program is subject to availability at the time of booking and is subject to change without notice.
LAND PROGRAMS FOR CRUISES ON THE m/s PAUL GAUGUIN
All PGC land and hotel program prices are based on double occupancy, per person. Single and triple room prices are available upon request. All programs include: transfers as applicable, inter-island flights or ferry in French Polynesia where necessary with corresponding price adjustments, breakfast daily, deluxe hotel accommodations and taxes, and PGC’s hospitality service in Tahiti. PGC reserves the right to substitute hotels of similar quality when and where necessary. Hotels, flights and transfers are based on components at time of printing and may change as necessary. Domestic flight/ferry arrangements for island programs beyond Papeete are made by local ground operators in Tahiti, and flight/ferry schedules are not always available in advance. Requests for additional nights may only be confirmed if flight schedules permit.
Cruise-only guests on the m/s Paul Gauguin may purchase the standard pre-cruise and/or post-cruise arrangements for a fee. Please contact reservations for details and pricing.
ADDITIONAL INFORMATION
As the air fares negotiated by PGC are very restricted, all tickets issued are nonendorsable and cannot be exchanged for another carrier or alternative routing. Any charges that result from a ticket alteration being made by or on behalf of the guest will be the sole responsibility of the guest. All airline tickets issued by PGC are refundable only to PGC. Any unused portion of the flight ticket must be returned to PGC, as appropriate. We will, in turn, determine the amount of refund due, if applicable. Preliminary flight itineraries will be available 60 days prior to sailing. Some airlines restrict the accumulation or use of “frequent flyer” miles in conjunction with fares used by cruise lines.
PGC reserves the right to choose the air carrier and routing from each gateway city and the right to use charter air service for guest air transportation. PGC also reserve the right to change airline routing for any reason and/or re-route guests without prior notice to the nearest departure city if adequate air service is unavailable. Occasionally, due to scheduling conflicts, an enroute overnight stay might be necessary. Should this be the case, PGC will advise you or your travel advisor about this at the time of confirming your air schedule. Unless otherwise specified in the cruise program description, any costs associated with the events described above will be the responsibility of the guest. Enroute overnights as described above are subject to change or cancellation due to changes in air scheduling.
As the air fares offered are negotiated at very favorable rates and are usually below published levels, availability is limited. PGC will do its utmost to secure these fares for you. However, the earlier you book your cruise, the more likely we will be able to obtain your ticket at this special negotiated fare. All air fares quoted are subject to change without notice. Air fares are not guaranteed until full payment for the cruise/air package has been received and documents/airline tickets have been issued. All guests who elect not to participate in PGC’s Air/Sea Program or do not purchase transfer arrangements from PGC will be responsible for their own transfer arrangements to and from the ship.
The Travel Desk on board can assist with post-cruise transfer arrangements once Guests are onboard.
PGC is not responsible for any expenses or costs incurred as a result of uncontrolled events, including but not limited to strikes, changes, delays and inclement weather as they relate to the ship’s schedule or by any change in schedules or routing by the guest, travel advisor or airline. In the case of loss of the airline ticket, the replacement and cost of same will be the responsibility of the guest. In addition, any flight change requests made within 60 days of departure, such as a new Air/Sea booking or changes to an existing booking, may be subject to a fee.

Presentation and context of the Authorized Reseller Website
a) Graphic identity
The layout, design and presentation of the Authorized Reseller Website must be broadly consistent with the logo and image of the “PONANT” and “PAUL GAUGIN” brands. However, the reseller must take care to avoid leading the consumer to confuse the official website www.ponant.com and the www.pgcruises.com website with its own website. It must therefore be clearly stipulated that it is a reseller website and not the official website. The PONANT and PAUL GAUGUIN CRUISES logos must be distinctly smaller in size than the reseller’s logo.
b) Equal treatment
PONANT and PAUL GAUGUIN CRUISES must be treated equally with other brands with respect to the position of the brand logo, the search engine, the sorting and filtering of cruises, the quality of the pictures of the cruises, and the descriptions of the cruises.
If the Website provides a search facility or a brand filtering feature, the PONANT and PAUL GAUGUIN CRUISES brands must be clearly included in them.
c) Links and search engine optimisation
- The Authorized Reseller must not include links to websites whose content may harm the brand and which are not consistent with the content definitions provided.
- The Authorized Reseller must take care to ensure that links provided in conjunction with retail or non-retail websites, and search engine optimization measures that have been paid for or have required the reseller to take deliberate action with respect to search engines and/or search engine optimization websites and/or social networks and/or websites designed to bring users into contact with the Authorized Reseller do not harm PONANT, PAUL GAUGUIN CRUISES, the cruises, the brands or the corporate images of PONANT or PAUL GAUGUIN CRUISES.
The Authorized Reseller agrees not to purchase any keyword containing the work “PONANT” (or any word or group of words resembling or including “PONANT”), or the names of any current and future ships belonging to PONANT (i.e. Le Ponant, L’Austral, Le Lyrial, Le Soléal, Le Boréal, Le Surville, Le Jacques-Cartier, La Lapérouse, Le Champlain, Le Bougainville, Le Dumont-d’Urville, Le Bellot, Le Commandant Charcot, m/s Paul Gauguin, etc.) on any search engine (i.e. Google, Yahoo, Bing, etc.) or any social network in any market whatsoever, whether in France or internationally, both while the present contract is in force and after the contract has ended.
The Authorized Reseller agrees not to mention PONANT or PAUL GAUGUIN cruises in its advertisements/links relating to discounted prices or promoting reductions or markdowns, and not to refer to them in association with any terms relating to discounts.
The Authorized Reseller similarly agrees not to use references, on its website, to reductions or markdowns in conjunction with the PONANT or PAUL GAUGUIN CRUISES ranges (except for the PONANT Bonus, or when specifically agreed for PAUL GAUGUIN), or to associate PONANT or PAUL GAUGUIN CRUISES with terms relating to discounts (e.g. “PONANT cruises at low prices”, etc.) for the purpose of not being visible in search engine referencing. The Authorized Reseller must also avoid using the terms “official website” and “official store” (or any other synonymous terms seen in search engine referencing) for the purposes of search engine optimization.
e) Modification – Prior agreement.
- The Authorized Reseller must submit to PONANT, for prior agreement, the URL address and domain name for the Website as well as its graphic style and its layout to ensure they comply with the present Internet Distribution Terms and Conditions and correspond to the needs and expectations of the consumer in terms of the information and advice presented and the level of quality offered by the PONANT or PAUL GAUGUIN CRUISES brand.
- The Authorized Reseller must not present and/or sell the Cruises on any website other than the website authorized by PONANT.
In case of alteration of the layout of the Website, or its address or domain name, with the prior approval of PONANT, the Authorized Reseller will be required to submit all the website elements and mock-ups relating to the modification in question to PONANT two months in advance.
If the alteration of the layout, domain name or URL of the Website is approved, the Authorized Reseller will be required to stop selling the Cruises on the Website for which approval had previously been granted up to that point.
f) Domain names.
The Approved Reseller agrees not to register any brand and/or domain name containing the word “PONANT” or the phrase “PAUL GAUGUIN” (or any word or groups of words resembling or including “PONANT” or “PAUL GAUGUIN”), or the names of any current and future ships belonging to PONANT (i.e. Le Ponant, L’Austral, Le Lyrial, Le Soléal, Le Boréal, Le Surville, Le Jacques-Cartier, La Lapérouse, Le Champlain, Le Bougainville, Le Dumont-d’Urville, Le Bellot, Le Commandant Charcot, m/s Paul Gauguin, etc.) in any market whatsoever, whether in France or internationally, both while the present contract is in force and after the contract has ended.
Presentation and context of the Cruises
a) Promotion and highlighting of the Cruises
- The Cruises must be promoted and highlighted on the Website/in the section of the Website dedicated to PONANT/PAUL GAUGUIN and must not be presented and/or combined in an indistinct manner with cruises from any of the Authorized Reseller's other suppliers. To this effect, the Authorized Reseller expressly agrees to only reproduce on the Website/in the section of the Website dedicated to PONANT/PAUL GAUGUIN CRUISES the photographs of the Cruises provided or validated by PONANT and where necessary to attribute all design and photo credits indicated by PONANT to them.
- Dedicated frames and windows with logos, colours and a formal layout validated by PONANT must be used for presenting the Cruises and differentiating them from items from other suppliers of the Authorized Reseller also presented on the Website, and this must be carried out in compliance with the colors, graphic style and representational elements used by the PONANT/PAUL GAUGUIN CRUISES brands and, in more general terms, with all applicable intellectual property rights.
Each time a modification is required (except for basic updates to departure details and prices), the Authorized Reseller agrees to submit screenshots of the pages of the Website on which the Cruises and/or any intellectual property rights applicable to PONANT/PAUL GAUGUIN CRUISES are displayed before they are made available online.
The Authorized Reseller is required to also ensure that the high quality of the Cruises and the PONANT/PAUL GAUGUIN CRUISES logos and brands is showcased and highlighted, in particular by abstaining from conflating them in any way with cruises from third parties and/or creating a contextual environment or applying sales techniques or a physical positioning likely to negatively impact the image of the Cruises and/or by not providing (or providing insufficient) help, advice and services and/or infringing any intellectual property right pertaining to PONANT/PAUL GUAGUIN.
The Website must not use flashing, bright or eye-catching messages, or any other method likely to devalue the top-of-the-range image of the Cruises and the PONANT/PAUL GAUGUIN CRUISES brand.
b) Cruise descriptions
- The Authorized Reseller must include on its Website both a photograph of the Cruise and the name of the Cruise together with its exact description and details of the price.
The Authorized Reseller agrees to use the names and descriptions of the Cruises exactly as provided by PONANT.
Any photographs used but not provided by PONANT/PAUL GAUGUIN CRUISES must be pre-approved by PONANT in all cases.
- The technical and marketing information relating to the Cruises must correspond to the technical and marketing information available in the most recent and up-to-date versions of the brochures and leaflets produced for the Cruises by PONANT/PAUL GAUGUIN CRUISES.
All representations of the Cruises, graphical representations of the PONANT/PAUL GAUGUIN CRUISES brand and text relating to the Cruises not supplied directly by PONANT/PAUL GAUGUIN CRUISES must be pre-approved in writing by PONANT before any use for distribution purposes.
Where necessary, PONANT agrees to provide the APPROVED RESELLER with the information it may be missing or any alterations that may be required to ensure that the marketing materials for the Cruises created by the Approved Reseller comply with PONANT’s brand image and intellectual property rights.
iii. The photographs, films and animations created by PONANT/PAUL GAUGUIN CRUISES to promote the Cruises or the PONANT/PAUL GAUGUIN CRUISES brand may potentially be incorporated into the Authorized Reseller’s website by prior agreement with PONANT and in accordance with terms and conditions to be defined at the time.
c) Sales policy
- The Approved Reseller must not engage in any activity likely to harm PONANT/PAUL GAUGUIN CRUISES, including but not limited to a sales policy based on permanent reductions or implemented by means of processes that may harm PONANT’s image.
Additionally, any sales promotions that take place will be run during the periods defined by the current legislation in force and/or in accordance with normal commercial practices, and the reduction rates will be of the kind normally applied in the sector.
- The Authorized Reseller must ensure that no terms likely to harm the image of the Cruises and/or that of the PONANT/PAUL GAUGUIN CRUISES brand, and/or which may be considered devaluing or unacceptably eye-catching appear on the website or form any part of the domain name (e,g, terms such as “big/fantastic/discount”, “chance”, “special offer”, “discount”, “reduction”, “sale”, etc.).
Similarly, price reductions and sales promotions must not be indicated or displayed in the form of crossed-out prices or flashy colors.
iii. The Cruises must not be used to attract attention to other cruises marketed and sold on the Website.
- The Approved Reseller agrees to ensure that there are no banners or advertising links leading to competitor cruises or to other cruises or services offered on the Website and relating to a different market sector.
Price Display:
We require our partners to comply with our Pricing Policy. PONANT does not authorize the display of prices that differ from those shown on our website.
